These Terms of Service ("Terms") govern your access to and use of HouseOps, a software platform for home-service businesses operated by Clear Kernel LLC ("HouseOps," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms.
By accessing or using HouseOps, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the service on behalf of a business, you represent that you are authorized to bind that business to these Terms. If you do not agree, do not use the service.
HouseOps provides tools to help home-service businesses manage leads, quotes, jobs, invoices, payments, and customer communications. Features may change, be added, or be removed over time. We do not guarantee that any particular feature will remain available.
You must be at least 18 years old to use HouseOps. You are responsible for the accuracy of the information you provide, for maintaining the security of your account, and for all activity that occurs under your account. Notify us promptly of any unauthorized access. You are responsible for the actions of any users you invite to your account, including staff.
HouseOps is offered on a subscription basis. New accounts may include a free trial period. After any trial, your subscription continues on a recurring (for example, monthly) basis until cancelled.
You agree not to misuse the service. You may not use HouseOpsto violate any law, infringe others' rights, send unlawful or unsolicited messages, attempt to gain unauthorized access to our systems or other accounts, or interfere with the integrity or performance of the service.
You retain ownership of the data you and your customers provide ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the service. You are responsible for the lawfulness of the Customer Data you collect and for obtaining any consents required from your own customers.
If you use HouseOps to contact your customers (for example, by text message or email), you are solely responsible for complying with all applicable laws and carrier requirements, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any messaging consent and opt-out rules. You are the sender of those communications.
We may send you account-related messages by text (SMS) or email, such as one-time verification codes used to sign in and essential service or security notices. These messages are part of providing the service and are not marketing.
Our consultation form offers two separate, optional text message programs from HouseOps (Clear Kernel LLC): customer care messages (appointment confirmations, appointment reminders, and replies to your inquiry) and marketing messages (offers, tips, and news about our software and services). Each program has its own opt-in checkbox. Consenting to one program does not enroll you in the other, and consent to either program is not a condition of any purchase.
For all text messages we send: message frequency varies; message and data rates may apply; reply STOP at any time to unsubscribe or HELP for help. Wireless carriers are not liable for delayed or undelivered messages. HouseOps does not send automated marketing text messages or automated voice calls to your customers on your behalf without your configuration and consent; your responsibilities as the sender of those communications are described in Section 6.
HouseOps relies on third-party providers to deliver certain features — for example, Stripe (payments), Twilio (messaging and voice), Resend (email), Intuit QuickBooks Online (optional accounting sync), and Amazon Web Services (hosting and storage). Your use of those features may be subject to the third party's terms, and we are not responsible for their services.
HouseOps, including its software, design, and content (excluding Customer Data), is owned by Clear Kernel LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. You may not copy, modify, reverse-engineer, or resell the service.
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Clear Kernel LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months preceding the claim.
You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the service or other users. Upon termination, your right to use the service ends. We may retain or delete Customer Data in accordance with our Privacy Policy and applicable law.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app notice). Your continued use of the service after the changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.
